This website is operated by Spectacular Events Pty Ltd – t/a SunSHINE Boxes. Throughout the site, the terms “we”, “us” and “our” refer to SunSHINE Boxes. The terms and conditions set out below apply to all sales made by SunSHINE Boxes, to you, the customers. The customer is said to have accepted and is bound by these terms and conditions if the customer places an order or accepts a delivery of goods. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you should not proceed to access the website or use any services.

SunSHINE Boxes hours of operation are 9.00am – 5.00pm, Monday to Friday.
We currently deliver to all Sunshine Coast postcodes listed at the bottom of this page. For areas outside of this, please contact us so that we can discuss delivery and availability options.

SunSHINE Boxes does not deliver on weekends or public holidays unless if by special arrangement due to arriving at a hotel/resort/holiday accommodation that day. If you fit into this category, please email us at: [email protected] so that we can make arrangements for you.

If an item is currently unavailable it will be substituted with a similar item of equal value.

Occasionally a box or package will be returned to us for one of the following reasons:

– a card was left but there was no response from the recipient to rearrange delivery

– the recipient is not known at that address or has moved

– address details are incorrect or insufficient.

If a parcel has an incorrect address and our couriers are unable to call the recipient to verify, the parcel will be returned to us. Boxes cannot be re-directed while in transit and will need to be returned to us before being sent to the new/correct address. We will inform you immediately of a box being returned to us. An applicable re-delivery fee will be passed on to you to facilitate the delivery of the box to the same or an alternative address. Orders cannot be cancelled once they have been prepared and passed on for delivery.

If the items in the box are faulty, please contact us within 24 hours of delivery and we will be happy to investigate with regards to a replacement or a refund.

Payment

Payments are accepted via our website through third party payment gateways and limited to the options listed at checkout. All payments are settled in AUD and any merchant fees for foreign conversation charged are payable by the customer. By confirming your purchase, you are confirming your agreement to all of these Terms.

All prices advertised on our website are in Australian Dollars (AUD) and are inclusive of goods and services (GST).
Please note: some boxes that contain GST-Free food items are taxed at an apportioned GST rate as per paragraph 75 of “Goods and services tax: Apportioning the consideration for a supply that includes taxable and non-taxable parts”



Goods and Returns

Goods cannot be returned unless we are required by law to do so. If we agree to a return, there may be a restocking and handling fee payable.
Several types of goods are exempt from being returned. Perishable goods such as food or flowers cannot be returned. If we agree to a return, as required by law, your item must be unused and in the same condition that you received it. It must also be in the original packaging. You must notify us within 24 hours of delivery to begin the returns process.

If a return is accepted, the customer is liable for a return fee of 50% as returned items are disposed of due to health and safety reasons.
The customer is liable for the cost of returning the goods to SunSHINE Boxes. Transport costs incurred as part of the original order are non-refundable and any transport fees are deducted from the refund amount.
You must obtain a return authorisation prior to returning the goods to qualify for any sort of refund.
Refunds will be issued after the goods have been returned and inspected.

Due to the nature of the Goods contained within the boxes, slight differences may occur in the box delivered. (e.g. colour variance in boxes, packaging and presentation). SunSHINE Boxes is not obliged to notify of changes made by suppliers to packaging.

We reserve the right to substitute products, of equivalent brand and value, in the event that the original product is unavailable. We will notify you where possible about the substitution and provide you with all available options.


Alcohol Delivery Disclaimer

SunSHINE Boxes supports the Responsible Service of Alcohol, and our owner holds a current RSA Certificate.

Under the Liquor Act 1992, it is against the law to supply liquor to a person in Queensland under the age of 18 years. It is also an offence for a person under the age of 18 years to purchase or receive liquor from another person.

In placing an order with SunSHINE Boxes for a gift box that contains alcohol, you warrant to SunSHINE Boxes that:

  1. you are over the age of 18 years,
  2. any person that you are obtaining the Goods for, or supply the Goods to, is over the age of 18 years,
  3. you will not take or supply any part of your order to any liquor-restricted area,
  4. gifts must be delivered between the hours of 7am – 7pm,
  5. gift boxes must be delivered as gifts to adults,
  6. the recipient may be asked to provide a valid ID as proof of age and to sign for the Goods,
  7. you must ensure that a person aged 18 years or over is available to accept these Goods.

Delivery fees are a set charge of $20.00 (incl. GST) per box to any Sunshine Coast postcode area.
This is added on at time of ‘check out’ when you place an order/purchase. For bulk orders, please contact us at: [email protected] to discuss.

We endeavour to deliver on ‘next business day’ of receipt within the Sunshine Coast area. Please note that all Boxes are mailed via Australia Post (Express) if outside of the main Sunshine Coast area. We shall notify you if there are any issues or queries due to unforeseen circumstances.

We shall text you ahead of time on all deliveries with our approx. delivery time. If you intend to visit the Sunshine Coast or are here on holidays, we shall contact you to ensure we are across your anticipated time of arrival to ensure there are no issues.

Please note that any cool items (e.g. cheese, some dips) will be delivered in a cooler bag with an ice pack to ensure that all is delivered cool and fresh.

We bear no responsibility for goods left unattended at your nominated delivery address that are lost, damaged or stolen. No refunds will be provided for goods or transport costs.

Privacy & Personal Information

SunSHINE Boxes operates in accordance to the Privacy Act 1988.

When you purchase something from our website, as part of the buying and selling process, we collect the personal information you give us such as your name, address, contact number and email address and/or the recipient’s name, address, contact number and email address. When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

The information held by SunSHINE Boxes will never be used for any purposes other than to maintain direct communication with you about your account and promotional offers. We shall not sell, distribute or share any of the personal data you provide with any other party. The personal data you provide is stored securely and is used only for the purposes to answer queries, process orders or help maintain the account.


Disclaimer of Warranties & Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free although we do all possible to ensure there are no issues. You agree to indemnify, defend and hold harmless SunSHINE Boxes and our parent company – Spectacular Events Pty Ltd from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
